Khaleda Zia banned from election for 22 years

BNP Chairperson Begum Khaleda Zia jailed for 7 years on Zia Charitable Trust corruption case. Then again, High Court revised the appeal of Anti Corruption Commission against the verdict of Zia Orphanage Trust corruption case. They declared the sentence will be 10 years instead of 5 years after revising their appeal. These two cases will keep her in the prison for 17 years. Lawyers are saying that, she might be banned to participate in any election for 22 years.
It is written on the constitution’s article paragraph numebr 66 (2 C) that, a person will be ineligible to participate in the election for 5 years if he or she has served minimum 2 years in the jail. Khaleda Zia is going to serve in total 17 years in the jail for two different cases. One has sentenced her for 10 years and the other one is for 7 years. Now, according to the constitution, Khaleda Zia will not be able to participate in the election for 5 years after getting out from the jail. So it can be said that, Khaleda Zia will not participate on the election for 22 years.

Constitution specialist Mahmudul Islam says, “According to Article 66 (2 C) of the constitution, a person who has sentenced for minimum 2 years then he or she will be ineligible to participate on the election. Furthermore, he or she will not be able participate on the election for 5 more years after getting out from the prison. Since BNP leader Begum Khaleda Zia has jailed for 17 years (separately for two different cases) so she has lost the ability to participate on the election for next 17 years and 5 years after serving her time. Since she is accused for another 42 cases and if the court finds her guilty for those as well then those times will be added with current years.

The court of Bangladesh sentenced Khaleda Zia for 5 years in jail for embezzling 2 crore and 10 lakh taka on 8th February 2018 from Zia Orphanage Trust.

Then again, 29th October 2018, court sentenced her for 7 years in jail for corrupting fund of Zia Charitable Trust. The court has also fined her 10 Lakh taka and in case of default she will be sent to the jail for six months more.

Meanwhile, the high court bench comprising with Justice M Enayetur Rahim and Justice Md. Mostafizur Rahman dismissed the appeal of Khaleda Zia of Zia Orphanage Trust corruption case on 30th October 2018.
